At MerchantSense, we are committed to protecting your privacy and to developing technology that gives you the most powerful and secure online experience. You can travel through most of our site without giving us any information about yourself. But sometimes we do collect information to provide services that you request, and this statement of privacy explains data collection and use in those situations.

What type of information does MerchantSense collect?

MerchantSense does not collect personal information on MerchantSense web sites unless you choose to provide personal information to MerchantSense. On selected MerchantSense web sites, MerchantSense collects personal information and resumes from candidates for employment and newsletter delivery, which is used by MerchantSense to provide the respective services.

Collecting your Personal Information

We will ask you when we need information that personally identifies you or allows us to contact you. You may choose to give us personal information, such as your name and address or your email id that may be needed, for example, to correspond with you. It is our intent to let you know how we will use such information before or as we collect it from you on the Internet.

Security of your Personal Information

MerchantSense uses reasonably commercial efforts to protect the security of your personal information and to honor your choices for its intended use. We also use commercially reasonable efforts to protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

Your personal information is never intentionally shared outside the company without your permission. Inside the company, data is stored in password-controlled servers with limited access. Your information may be stored and processed in Canada or any other country where MerchantSense, its subsidiaries, affiliates or agents are either located or store its hardware.

When you provide us with personal information, MerchantSense will not share that information with third parties without your permission. It will only be used for the purposes stated.

Protection of Children's Personal Information

The MerchantSense site does not publish content that is targeted to children

Use of Cookies

To ensure we are publishing content customers need and want MerchantSense collects aggregated site-visitation statistics using cookies. We do not track individuals’ use of the site.

When someone visits the site, a cookie is placed on the customer’s machine (if the customer accepts cookies) or is read if the customer has visited the site previously.

Web beacons, also known as clear gif technology, or action tags, assist in delivering the cookie. This technology tells us how many visitors clicked on key elements (such as links or graphics) on a MerchantSense web page. We do not use this technology to access your personally identifiable information on MerchantSense; it is a tool we use to compile aggregated statistics about MerchantSense web site usage. We do not share tracking information outside of MerchantSense, and do not allow other companies to place clear gifs on our sites.

If you choose to not have your browser accept cookies from the MerchantSense web site, you will be able to view the text on the screens, however you will not experience a personalized visit nor will you be able to subscribe to the service offerings on the site.

Changes to this Statement

MerchantSense will occasionally update this privacy statement. When we do, we will also revise the “last updated” date at the top of the privacy statement.

While MerchantSense uses commercially reasonable efforts to protect the information and data solicited and stored, MerchantSense nevertheless, cannot guarantee such efforts will be successful and therefore, MerchantSense makes no warranties regarding the use of the web site and the safety, security and integrity of the information and data collected and stored. MerchantSense HEREBY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

By accessing the MerchantSense web site, you release MerchantSense from any and all claims, causes of action and/or liability related in any way to the web site under any legal theory. IN NO EVENT WILL MERCHANSHIELD BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR SPECIAL DAMAGES. Notwithstanding the foregoing, the total cumulative liability for MerchantSense for any claim, cause of action and/or liability shall not exceed ten dollars ($10.00).
